Measures for the Application and Issuance of Residence Permits for Hong Kong, Macao and Taiwan Resid

Recently, the General Office of the State Council issued the Measures for the Application and Issuance of Residence Permits for Residents of Hong Kong, Macao and Taiwan, and issued a circular requesting the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, and all ministries and commissions of the State Council and all institutions directly under the State Council to implement them conscientiously.

 

The Measures for the Application and Issuance of Residence Permits for Residents of Hong Kong, Macao and Taiwan are set out below.

 

Article 1 These Measures are formulated in accordance with the relevant provisions of the Interim Regulations on Residence Permits for the purpose of facilitating residents of Hong Kong, Macao and Taiwan to work, study and live in the Mainland (Mainland) and safeguarding the lawful rights and interests of residents of Hong Kong, Macao and Taiwan.

 

Article 2 Where a resident of Hong Kong, Macao or Taiwan travels to the Mainland (mainland) for more than half a year and meets one of the conditions for legal and stable employment, lawful and stable residence and continuous education, he may, if he wishes, apply for a residence permit in accordance with the provisions of these Measures.

A resident of Hong Kong, Macao or Taiwan under the age of 16 may apply for a residence permit by his guardian on his behalf.

 

Article 3 The contents of a resident certificate of Hong Kong, Macao or Taiwan shall include: name, sex, date of birth, address of residence, citizen's identity number, photograph, fingerprint information, valid period of the certificate, issuing organ, number of issuance, and number of exit and entry certificates of Hong Kong, Macao and Taiwan residents.

The citizen identity number shall be compiled by the public security organ according to the national standards of the citizen identity number. The Hong Kong resident identity number address code is 810000, the Macao citizen identity number address code is 820000, and the Taiwan citizen identity number address code is 830000.

 

Article 4 The public security organs at all levels shall actively coordinate and cooperate with the relevant departments of Hong Kong and Macao affairs, Taiwan affairs, development and reform, education, civil affairs, judicial administration, human resources and social security, housing and urban construction, transportation, health and health, etc, Well protect the rights and interests, service and management of the holders of residence permits.

 

Article 5 The public security organs at all levels shall establish and improve the management information system for residence permits of Hong Kong, Macao and Taiwan, and effectively conduct the acceptance, examination and approval of applications for residence permits and the making, issuance and administration of certificates.

 

Article 6 The period of validity of residence permits for residents of Hong Kong, Macao and Taiwan shall be five years and shall be issued by the public security organ of the people's government at the county level.

 

Article 7 The resident certificate of Hong Kong, Macao and Taiwan shall be made by the technical standard of the resident identity card, and shall have the functions of both visual reading and machine reading. The contents of the visual reading and machine reading shall be limited to the items as prescribed in Article 3 of these Measures.

 

The form of residence permit for residents of Hong Kong, Macao and Taiwan shall be worked out by the Ministry of Public Security in consultation with the Hong Kong and Macao Affairs Office of the State Council and the Taiwan Affairs Office of the State Council.

The residence permits of residents of Hong Kong, Macao and Taiwan shall be uniformly made by the public security organ of the provincial people's government.

 

Article 8 To apply for a residence permit, a resident of Hong Kong, Macao or Taiwan shall fill out a Registration Form for Application for a Resident Permit of Hong Kong, Macao or Taiwan, and submit his or her exit and entry certificate for Hong Kong, Macao or Taiwan residents, Submit to the public security station designated by the public security organ of the people's government at the county level his/her place of residence, employment, study and other certification materials to the public security station designated by the public security organ at the county level where he/she resides or the residence certificate hall.

 

The residence address certificate includes the house lease contract, the house property right certificate, the house purchase contract or the house lessor, the employer, the residence certificate issued by the school. Article 9 Where the valid residence permit expires, the certificate is damaged beyond recognition or the residence of the holder changes, the holder may apply for a new certificate. If the residence permit is lost, the applicant may apply for a replacement. When applying for a replacement of a new one, the applicant shall present his or her exit and entry certificate for Hong Kong, Macao and Taiwan residents.

When applying for a new certificate, the original certificate shall be surrendered.

 

Article 10 Where a resident of Hong Kong, Macao or Taiwan applies for a residence permit, if the application meets the handling conditions, the public security organ that accepts the application shall issue a residence permit within 20 working days from the date of acceptance. In areas with poor transportation, the processing time may be extended appropriately, but the extended time shall not exceed 10 working days.

 

Article 11 Where a resident of Hong Kong, Macao or Taiwan needs to prove his/her identity when engaging in relevant activities in the Mainland (mainland), he/she shall have the right to use his/her residence permit to prove his/her identity. The relevant units and their staff shall not refuse to do so.

 

Article 12 The holder of a resident certificate of Hong Kong, Macao and Taiwan shall enjoy the right to work and employment, participate in social insurance, and deposit, withdraw and use the housing provident fund according to law at the place of residence. The people's government at or above the county level and its relevant departments shall provide the following basic public services to the holders of residence permits of residents of Hong Kong, Macao and Taiwan:

Article 13 Holders of residence permits of Hong Kong, Macao and Taiwan shall enjoy the following facilities in the Mainland (mainland):

Article 14 State organs and their functionaries shall keep confidential the personal information of the holder of the residence permit known to them in the course of their work.

 

Article 15 Where a holder of a resident certificate of Hong Kong, Macao or Taiwan falls under any of the following circumstances, his residence permit shall be declared invalid by the issuing authority:

(1) The applicant loses his status as a resident of Hong Kong, Macao or Taiwan;

(2) using false certification materials to defraud a resident certificate of Hong Kong, Macao or Taiwan;

(3) It may cause harm to the sovereignty, security, honour and interests of the state;

(4) The exit and entry certificates of Hong Kong, Macao and Taiwan residents have been cancelled, seized or declared invalid (except under the circumstances of normal replacement).

 

Article 16 Whoever, in violation of the relevant provisions, handles or uses a residence permit shall be punished in accordance with the relevant provisions of the Interim Regulations on Residence Permits.

State organs and their functionaries who violate the relevant provisions on residence permit administration shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law.

 

Article 17 To apply for a residence permit for the first time, one shall be exempted from the cost of a certificate. For the replacement or replacement of a residence permit, the applicant shall pay the fee for the certificate. The specific charging methods shall be governed by the relevant provisions of the Provisional Regulations on Residence Permits.

 

Article 18 These Measures shall not apply to residents of Hong Kong, Macao and Taiwan who have moved into the Mainland (mainland) to settle down in China (Mainland) according to the relevant provisions.

 

Article 19 The term "residents of Hong Kong, Macao and Taiwan" as mentioned in these Measures shall be collectively referred to as "residents of Hong Kong, Macao and Taiwan" and "residents of Taiwan". Among them, "Hong Kong and Macao resident" means a Chinese citizen who has settled in Hong Kong or Macao Special Administrative Region and does not have a Mainland domicile; "Taiwan resident" means a Chinese citizen who has settled in the Taiwan region and does not have a Mainland domicile.

 

For the purpose of these Measures, "Residence Permit for Hong Kong, Macao and Taiwan Residents" includes the residence permit of Hong Kong and Macao residents of the People's Republic of China and Taiwan residents of the People's Republic of China.

For the purpose of these Measures, "exit and entry certificates for residents of Hong Kong, Macao and Taiwan" include exit permits for residents of Hong Kong and Macao to and from the Mainland, and five-year exit permits for Taiwan residents to and from the Mainland.

 

Article 20 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, in light of the comprehensive carrying capacity and the needs of economic and social development of their respective administrative regions, formulate detailed rules for implementation in accordance with these Measures.

 

Article 21 These Measures shall come into force on September 1, 2018.
